1. Contract between the Client and Peru Trails
This travel contract is governed by the International Convention on Travel Contracts (Brussels, 1970). It establishes that any cancellations, changes, or substitutions for reasons attributable to the traveler or the agency may incur penalties. Cancellations or modifications caused by unforeseen circumstances or force majeure (such as natural disasters or social disturbances) will be regulated as detailed in this contract.
To confirm a booking with Peru Trails, an initial deposit is required as specified below. A booking is accepted and the contract becomes binding once we receive the deposit from the Client. The contract covers all individuals listed on the booking form. The person signing the form confirms that they have full authority on behalf of all listed persons and that everyone is fully aware of and accepts these terms.
2. Bookings and payments
Student Discount & Children:
- Student Discount: To qualify for the student discount, please send us a scanned copy of both sides of your student ID card when you make the booking. Valid student cards include the International ISIC card.
- Children: Children up to 15 years of age will be regarded as students, under the condition that you provide us a copy of the passport when you make the booking.
Group Size Requirements
A minimum of two (2) people is required to run a trek, with a maximum of eight (8) people per group.
Prices
(Prices vary for each trek, tour, or travel package – specific details will be listed on the respective page.)
- Trekking and Packages: An initial payment of USD 100 per person is required.
- Day Tours: An initial payment of USD 50 per person is required.
Payment Terms
The remaining balance must be paid 7 days prior to the start of the trek, tour, or travel package. In certain cases, the balance may be settled upon arrival in Cusco, subject to prior arrangement and confirmation by Peru Trails.
Deposits & Payment Methods
Deposits must be made using our designated payment options (such as PayPal). Detailed payment instructions are available on our website under “Our Payment Options.”
Availability of Permits
For treks that require permits (e.g., Machu Picchu or Huayna Picchu), please inform us of your desired dates and locations. We will confirm permit availability and any additional fees required.
Booking Procedure
To confirm your booking, please send an email to info@perutrails.com with the following details for each guest:
- Full name and surname
- Passport number
- Date of birth
- Nationality
- Gender
Alternatively, you may complete our online booking form available on our website.
Currency
All prices are quoted in United States Dollars (USD) and do not include applicable Peruvian sales taxes unless stated otherwise.
3. Changes by the client
Any modifications to the original booking must be confirmed in writing by the person signing the booking form. Should the Client request any changes to the itinerary after receiving a booking confirmation, any additional costs or charges incurred as a result will be the responsibility of the Client. While we will make every reasonable effort to accommodate change requests, availability of services on short notice cannot be guaranteed.
4. Cancellations by the client
- Non-refundable deposits: The initial deposit is non-refundable if canceled within 30 days of the scheduled trek, tour, or travel package.
- Cancellation policy:
- If the Client cancels 30 days or more before the scheduled date, a refund of the booking fee will be issued minus an administrative fee of 10% and any non-recoverable costs (such as permit tickets already purchased).
- Cancellations made less than 30 days prior to the scheduled date will incur a penalty equal to the initial deposit.
- For cancellations made within 7 days of the trek or tour, the Client will forfeit the deposit and be liable for any additional costs incurred.
- Ticket reservations: For treks requiring specific permits (e.g., the Inca Trail), no refunds will be issued for fees paid to the respective authorities.
- Written notice: All changes or cancellations must be communicated in writing via email or fax and will be considered effective only upon written acknowledgment by Peru Trails.
- Partial cancellations: In the event of partial cancellations, remaining members of the group may incur additional charges (such as under-occupancy or single room supplements).
In cases where a trek, tour, or package is canceled due to force majeure (e.g., natural disasters or civil unrest), Peru Trails will make every effort to proceed as planned but cannot refund deposits for tickets or other non-recoverable expenses.
5. Changes and cancellations by Peru Trails
Peru Trails reserves the right to change or cancel any facilities, services, or pricing details at any time without prior notice or compensation. If changes are made for reasons other than force majeure, the Client has the right to:
- Accept the changes,
- Swap the booking for an alternative tour or trek, or
- Cancel the booking for a full refund.
Force majeure includes, but is not limited to, war, civil unrest, industrial disputes, terrorist activities, natural or nuclear disasters, adverse weather conditions, technical or maintenance issues with transportation, or other events beyond our control.
We will make every effort to communicate any changes to the Client as early as possible. However, we assume no liability for any loss of enjoyment or inconvenience resulting from such changes.
6. Passport, visa, and vaccinations
Once a booking is confirmed, the Client must provide all necessary personal information (including full name, passport number, gender, and age) to the relevant authorities (e.g., for Machu Picchu permits). All details will be verified at the start of the trek or tour. If the information does not match, the Client may be denied participation.
- Passport updates: Should the Client’s passport information change between booking and the trip, updated documentation must be provided immediately. Failure to do so may result in additional charges (e.g., a fee of USD 12.00 for processing changes with the relevant authorities).
- Travel documentation: It is the Client’s responsibility to ensure possession of a valid passport, visa(s), and any required vaccinations or medications for the duration of the trip.
7. Age, health, fitness, and participation
Health:
The Client must disclose any pre-existing illnesses or physical conditions that may affect their ability to participate in the trek, tour, or travel package. It is advisable to consult with a doctor or travel clinic prior to the trip. While our guides carry a first aid kit, the Client is responsible for carrying any personal medication and necessary prescriptions.
Fitness:
Trekking and adventure travel in the Andean mountains require a certain level of physical fitness. Clients are encouraged to prepare adequately to ensure a safe and enjoyable experience.
Participation:
By booking with Peru Trails, the Client confirms that all participants are fit and capable of undertaking the journey and that they have read, understood, and accepted these Terms and Conditions.
